No. 279 of the 21st. September, 1904, deal with the

question of Dr. Koch drawing Dr. Thomson's house allowance
whilst the latter was on leave, and Your Lordship will
observe that in the 6th. paragraph of his Despatch Mr. ----
Lyttelton stated "I am not satisfied that Dr. Koch has a
"very strong claim", and proceeded to grant him some
addition to his emoluments on the ground that he had been
led to expect that he would receive some payment in con-
-sideration of the fact that he had to live in the vicinity
of the Gaol.
It appears to me therefore that
there is no analogy between the present case and Dr.
Koch's case, but that if there is an analogy Kr. Lyttel-
➡ton's opinion that Dr. Koch had not a very strong claim
implied that similar claims would not be entertained in
future. Moreover there is this difference between the two
cases that when Mr. Moore was appointed Assistant Surgeon
and assigned to Gaol duties he was not led to expect that
